These are our Terms and Conditions, which form the basis for processing and completing your purchase.


Scope and Provider

These Terms and Conditions apply to all orders placed with the online store Adventure Shop, based in Hong Kong.
We only contract based on these Terms and Conditions.
The contractual language is exclusively German.


Conclusion of Contract

The presentation of our products in the online store does not constitute a legally binding offer. It is merely an invitatio ad offerendum—an invitation to submit an offer.
By clicking the “Place Order with Obligation to Pay” button, you submit a binding purchase offer.
The confirmation of receipt of your order (order confirmation) does not constitute acceptance of the contract. Therefore, no valid contract is concluded merely by receiving the confirmation email.
A valid purchase contract is only concluded once we expressly accept the contract or, without prior explicit acceptance, ship the goods to you.


Prices and Shipping Costs

The prices valid at the time of ordering apply. The prices listed in the shop are final prices, meaning they include statutory VAT.
Shipping costs are shown at checkout and calculated based on the delivery address.


Payment

Adventure Shop offers you the option to pay by credit card and PayPal.
We reserve the right, for each order, to exclude certain payment methods and refer to others.
If paying by credit card, your card will be charged when the goods are dispatched.
If you choose PayPal, you will be redirected to the PayPal website. To pay via PayPal, you need a PayPal account. After placing your order, we instruct PayPal to initiate the payment process.


Default in Payment

If you default on a payment, you are obligated to pay statutory default interest of 4%.
A reminder fee of €2.50 will be charged for each reminder letter sent after default, unless higher damages can be proven.
You agree to receive invoices, credit notes, and reminders either electronically or in paper form.


Delivery and Retention of Title

The goods remain the property of Adventure Shop until full payment has been made.
The goods are shipped directly from our warehouse in Europe or China.
If we have properly ordered the goods from our suppliers but are not supplied correctly or on time (congruent coverage transaction), we are exceptionally not obligated to deliver the ordered goods.
This is provided that we are not at fault for the unavailability and that we have informed you immediately. In the case of unavailability or contract withdrawal, payments already made will be refunded promptly.


Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period begins on the day you, or a third party named by you who is not the carrier, takes possession of the goods.
To exercise your right of withdrawal, you must notify Adventure Shop of your decision to withdraw via a clear declaration (e.g., by post or email).
The withdrawal deadline is met if you send your notice before the 14-day period expires.
Already dispatched packages cannot be canceled and are therefore excluded from the right of withdrawal.
Withdrawal or cancellation of the order due to shipping delays is not permitted; delivery must be awaited.


Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you promptly and no later than 14 days from the day we receive your withdrawal notice.
We will use the same payment method you used for the original transaction, unless expressly agreed otherwise; no fees will be charged for this refund.
Adventure Shop reserves the right to withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us immediately and no later than 14 days from the day you notified us of your withdrawal. The deadline is met if you dispatch the goods within this 14-day period.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functionality of the goods.

Please handle the items with care. Use them only for the purpose of trying them on in a typical manner.
We ask for your understanding that we cannot accept visibly worn, washed, damaged, or soiled items.
Items must be returned unused, in their original packaging, and with all included components.
Your statutory right of withdrawal remains unaffected. However, we reserve the right to demand appropriate compensation for any damage in such cases.


Refusal to Accept Delivery

Refusing to accept the delivery of a parcel is not permitted.
If the delivery is unjustifiably refused, the buyer must cover both the shipping and return costs.


Statutory Warranty

Your statutory warranty rights apply in full.


Transport and Other Damages

If you receive goods with obvious transport damage, please report this to the delivery service immediately and contact us as soon as possible.
Likewise, any obvious material or manufacturing defects must be reported to us directly.
Failure to make such complaints does not affect your statutory rights, but the sooner you notify us, the quicker we can act.


Final Provisions

If any provision of these Terms and Conditions becomes invalid, the validity of the remaining provisions remains unaffected.
Contracts between you and us are governed exclusively by Austrian law, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations in your country of residence remain unaffected by this choice of law.
